Fans of actor Park Si Hoo were surprised when the Western Seoul Police Dept. had decided to prosecute the actor in the rape case brought against him by a trainee only known to the public as “A“.
“A” stated that they had been drinking the night of the rape, and that she had passed out before Park had taken advantage of her. The actor said that “A” had been sober when they left the restaurant, and was with him and “K“, his friend and continued to text through the evening, proving she wasn’t drunk. Park claims that the sex was consensual, and that there was no rape that night. “A” also had taken drug tests, which turned up negative for any date rape drug.
The changing attitudes towards the definition of rape has affected this case. Last year for example, a woman who had been drinking during a date was had put her at risk of not being believed by police when reporting sexual assault. But, due to last year’s scandal involving a talent agent sexually assaulting trainees has contributed to the pressure put on police to take claims of rape more seriously. This means that they must presume that the woman is innocent, even if she had been drinking the night of the assault.
Last year, according to Korea’s Sexual Violence Relief Center, only 10% of all rape cases were ever reported because the female victims said that they feared that they wouldn’t be believed. However, in November of last year, an appeals court had ruled in favor of a rape victim after a lower court had ruled that the defendant was innocent, saying that, “the woman’s injuries were not significant enough to prove rape.” This was considered a landmark case on the subject.
However this case turns out, Park Si Hoo’s case may be the key for police and prosecutors to prove that they are taking claims of rape more seriously.
